ADP: Action Star - Privacy Policy

At Performance Institute (U Perform Athletics Ltd.) [We], your privacy and the protection of your personal information is of the utmost importance to us. U Perform Athletics Ltd. takes great measures to protect your information. This policy is developed in compliance with British Columbia’s Personal Information Protection Act (“PIPA”). The PIPA puts in place rules and policies for how organizations such as ours can collect, use and disclose your personal information.

Personal information includes any information regarding an identifiable individual. Such information could include but is not limited to: name, birth date, address, phone, email, fax, sex, family status, disclosed medical history and training history.

U Perform Athletics Ltd. collects personal information for the purpose of verifying identities, customizing marketing, promotional and informational materials, corresponding with customers, registration, order fulfillment and to provide requested services to clients.

We will only collect and use personal information that is necessary to fulfill the purposes identified in this policy. U Perform Athletics Ltd. will not collect, use or disclose personal information except for the identified purposes unless we have received further consent from the individual. We will only collect, use or disclose personal information in accordance with PIPA.

U Perform Athletics Ltd. discloses personal information at the request or consent of the individual or in case of emergency or when authorized by PIPA or required by law. We will never sell or rent personal information to anyone outside U Perform Athletics Ltd. unless those individuals have given consent in accordance with PIPA.

Individuals can consent orally, in writing or electronically and their consent may be implied or express depending on the nature and sensitivity of the personal information. Implied consent is given when, for the purpose of collecting, using, or disclosing personal information, it is considered obvious and the individual voluntarily provides personal information for that obvious purpose. Individuals will be informed of collection and given a chance to withdraw their consent. PIPA requires that we inform individuals that a withdrawal of consent will result in an inability to provide certain goods or services.

U Perform Athletics Ltd. will maintain records of personal information used to make a decision that directly affects individuals for at least one year after said decision is made as required by PIPA. As subject to the one-year retention requirement, we will only retain personal information for as long as necessary to fulfill the identified purposes or as long as required for a legal or business purpose.

U Perform Athletics Ltd. has security measures and arrangements in place to prevent against risks such as unauthorized access, collection, use, disclosure, copying, modification or disposal of personal information. These methods include but are not limited to: anti-virus, firewall, file backups, password protection, and restricted file access. We will also employ reasonably secure methods whenever destroying personal information.

We will make all reasonable efforts to ensure that personal information that we collect, use or disclose is accurate and complete. Individuals may contact us to correct any errors or omissions in their personal information.

Individuals have the right to access their personal information under U Perform Athletics Ltd’s custody or control. A request for access must be made in writing. We may require individuals to prove their identity before giving them access to their personal information. We will give individuals their personal information under our control, information about the ways in which their information is or has been used, and the names of the individuals and organizations to which their personal information has been disclosed. PIPA allows us to charge a “minimal” fee for providing an individual with access to his or her personal information. If a fee is required, we will give the individual a written fee estimate in advance. We may require payment of a deposit or the whole fee before releasing the requested information. We will provide requested personal information within 30 business days after it is requested or we will give written notice if we need more time to respond. In some cases, we may not give an individual access to certain personal information where authorized or required by PIPA to refuse access. If U Perform Athletics Ltd. refuses an access request, we will tell the applicant in writing, stating the reasons for our refusal and outlining further steps that are available to the applicant (including any internal review by our organization and the right to ask the Office of the Information and Privacy Commissioner for British Columbia to review the decision).
